General Terms and Conditions
These specific terms and conditions for the Supply & Fit Partner Program are supplementary to Optique Line’s general terms and conditions of the Supply & Fit Partner Program Agreement 2024. The general terms and conditions will be updated to include a section specific to the Supply & Fit Partner Program.
Freight-Free Overnight Deliveries
Optique Line uses third-party couriers for the delivery of goods. While we strive to provide overnight deliveries, we do not guarantee overnight delivery and will not be liable for any loss incurred by the retailer if the goods are not delivered overnight. Optique Line will use reasonable efforts to ensure timely delivery.
Force Majeure
Optique Line is not liable for delays or failures in delivery caused by circumstances beyond our control, including but not limited to natural disasters (e.g., cyclones, floods), strikes, or other significant disruptions. In such events, Optique Line will make reasonable efforts to deliver the goods as soon as possible.
Stock Availability
If Optique Line is unable to fulfill an order due to supply issues, we will notify the participant promptly and work to resolve the issue. Participants are required to maintain a stock of 60 pieces for the Gold tier and 100 pieces for the Platinum tier, supplied by Optique Line. If Optique Line cannot supply the required stock, we will not be held liable for any resulting losses or breach claims.
Account Credit Application
The account credit ($200 for Gold and $500 for Platinum) is available every 24 months at the start of each 2-year agreement extension. This credit is contingent on the account being in normal trading terms. The credit will then be applied to future orders.
Minimum Stock Holding
Participants must maintain at least 60 pieces (Gold tier) or 100 pieces (Platinum tier) of Optique Line products on display at all times. This requirement ensures that the participant’s display reflects the range and quality of Optique Line products and helps maximize the benefits of the program.
Warranty Coverage
Optique Line offers a 2-year warranty for all eyewear products under the Supply & Fit Partner Program. The warranty is available to participants in both the Gold and Platinum tiers.

Your continued use of the Optique Line website constitutes an affirmative acknowledgment and agreement by you that you accept and agree to abide and be bound by these Terms of Use and any of its amendments.
This agreement will be governed by and construed in accordance with the laws of Victoria, Australia. You irrevocably and unconditionally submit to the non-exclusive jurisdiction of the courts of Victoria. If any provision of this agreement is found to be invalid or unenforceable by a court of law, such invalidity or unenforceability will not affect the remainder of the agreement which will continue in full force and effect.
All material on the Optique Line website is provided in good faith. It is derived from sources believed to be accurate and current as at the date of publication. Your use of the Optique Line website is at your sole risk. Access to the Optique Line website is provided on an ‘as available’ basis. Neither Optique Line, its related bodies corporate nor their directors or employees make any representation or warranty that (i) any material on the Optique Line website will be reliable, accurate or complete (nor do they accept any responsibility arising in any way for errors or omissions from that material); (ii) your access to the Optique Line website will be uninterrupted, timely or secure. Optique Line will not be liable for loss resulting from any action or decision by you in reliance on the information on the Optique Line website or any interruption, delay in operation or transmission, virus, communications failure, Internet access difficulties or malfunction in equipment or software.
Optique Line and its affiliates attempt to be as accurate as possible. However, Optique Line does not warrant that product descriptions are accurate, complete, reliable, current or error-free. If a product offered by Optique Line itself is not as described, your sole remedy is to return it in unused condition.
The Trade Practices Act and similar state and territory Legislation in Australia may confer rights and remedies on you in relation to the provision by Optique Line of goods or services on the web site which cannot be excluded, restricted or modified (“Non-excludable Rights”). Optique Line does not exclude any Non-excludable Rights but does exclude all other conditions and warranties implied by custom, law or statute.
Except as provided for by the Non-excludable Rights: a) all Content is provided “as is” and without warranties of any kind, either express or implied, b) Optique Line and its suppliers expressly disclaim all warranties of any kind, including but not limited to implied warranties of merchantability and fitness for a particular purpose, c) Optique Line does not warrant that the functions contained in any Content or any Communications Facility or your access to the web site will be uninterrupted or error-free, that any defects will be corrected or that the web site or the server which stores and transmits Content to you are free of viruses or any other harmful components, d) Optique Line does not warrant or make any representation regarding your access to, or the results of your access to, the web site (including any related or linked web sites) or any Content in terms of correctness, accuracy, timeliness, completeness, reliability or otherwise, and e) you (and not Optique Line) assume the entire cost of any necessary verification, maintenance, repair and/or correction of any relevant Content.
Under no circumstances (including but not limited to any act or omission on the part of Optique Line) will Optique Line or its affiliates be liable for any indirect, incidental, special and/or consequential damages or loss of profits whatsoever which result from any use or access of, or any inability to use or access, the web site or any Content. To the fullest extent permitted by law, Optique Line’s liability for breach of any implied warranty or condition which cannot be excluded is limited at the option of Optique Line to the following:
in the case of services supplied or offered by Optique Line, (a) the supply of the services again, or (b) the payment of the cost of having services supplied again; and in the case of goods supplied or offered by Optique Line, (c) the replacement of the goods or the supply of equivalent goods, (d) the repair of such goods, (e) the payment of the cost of replacing the goods or acquiring equivalent goods, or (f) the payment of the cost of having the goods repaired.
These conditions and all other specific and additional terms which govern your use of and access to the Optique Line website will be governed by and construed in accordance with the laws of the state of Victoria, Australia.

The Optique Line website may display third-party advertisements, which may or may not contain hyperlinks or referral buttons to web sites operated by third parties. The display of such advertising does not in any way imply a recommendation or endorsement by Optique Line or its related companies of the relevant advertiser, its products or services or any such linked website.
Suppose you contact a third party using functionality provided on the Optique Line website, including via email. In that case, Optique Line accepts no responsibility for any actions taken by that third party in response to your communication or for any transactions entered into between you and the relevant third party.
NOS Eyewear frames are not eligible for approval-only orders or stock rotations due to being bespoke items manufactured for each order. However, they are still covered under our standard warranty for any manufacturing defects.
Optique Line endeavours to maintain the accuracy of product images, product descriptions, stock availability and prices. We do however reserve the right to cancel an order and/or reverse a payment if an order has been placed based on erroneous information.
